Welcome to the NikPoints Rewards
Programme page.
In an effort to reward our loyal customers we have introduced
the NikPoints Rewards Programme loyalty scheme.
Earning NikPoints
If you wish to just shop without earning points you
DO NOT need to register at the checkout.
If you DO wish to earn points then you must
register at the checkout and then each time you shop
you will need to make sure you have logged in. (The
shop should remember you though)
Each time you shop with us the NikPoints will be added
automatically to your account, the points you have earned
is shown in the checkout section.
The number of points for each item will normally
be the equivalent of 1 point per whole pound spent.
Points are not earned on Shipping.
We reserve the right to amend the number of points
for each item without notification.
You may redeem NikPoints at the checkout in either full
or part payment for your order, depending upon your NikPoint
balance at the time. Your balance will be displayed for
you at that point in time.
You can check your points balance at any time by logging
into your account here,
this will also allow you to see past order history should
you wish. The available history will only start from when
you register.
We will also manually add NikPoints to registered customers
who order over the phone or via email. Please remember
to remind us to add these for you though ! It may
not be "automatic" we're only human.
As with all of these things there are some terms which
need to apply (blame the lawyers).
Registering for NikPoints implies your acceptance of
these terms & conditions.
Earn extra points with Refer a Friend
If you refer a friend to us and they place their first
order in excess of £50, we will credit you with
200 Nikpoints. In order for this to your friend must enter
at the checkout who refered them. Please make sure that
they give enough info for us to clearly identify you.
For instance "John Smith" might not be wuite
good enough.
Terms and Conditions
The NikPoints Rewards Programme is for the use
of residents of the United Kingdom aged 18 years or
over. Residents of other countries will be accepted
into the Programme, however it is their sole responsibility
to ensure that the collection and redemption of NikPoints
does not contravene any local laws regarding sales
promotion or sales incentive schemes. If such activity
is deemed to contravene any local laws, R3 Midlands
Ltd. may at their discretion close such accounts as
are held in these countries.
An individual can join the programme once only.
An individual maintaining multiple NikPoints accounts
can be removed from the Programme, at R3 Midlands
Ltd. sole discretion.
As a customer you agree to provide only true and
accurate information to the NikPoints Rewards Programme
(including its advertisers and partners) at all times.
Customers from households which contain more than
one NikPoints member may be required to provide proof
of their identity and address before rewards are despatched.
By enrolling in/or using the NikPoints Rewards Programme
you agree that you have read and understand this Agreement
and that your membership in the Programme will conform
to its terms and conditions.
NikPoints members may earn NikPoints for joining
of the Programme; taking advantage of NikPoints earning
opportunities within the Programme and any other third
party websites; reading and responding to offers from
participating advertisers and partners via email and
complying with the terms of other offers or Programmes
from NikPoints or other companies.
NikPoints reserve the right to remove all accrued
points from any account that has been dormant for
a period of 12 months or more. We will make every
effort to contact the account holder, via their nominated
email address, to notify the account holder if the
accrued points are at risk of removal. If a reply
is received confirming that the account is still active,
R3 Midlands Ltd. will continue to maintain the points
balance. In the absence of a satisfactory response,
the accrued points will be forfeited, though the account
will remain open.
NikPoints reserve the right to terminate any account
that is not activate (i.e. does not earn any NikPoints)
within 3 months of joining. NikPoints will attempt
to contact the account holder prior to this occurring
via the email address supplied.
As a customer, you are entitled to earn NikPoints
in the prescribed manner and amount as detailed on
the Divingniknaks web site and through authorised
communications by R3 Midlands Ltd., its partners and
clients to NikPoints members. The methods of earning
NikPoints, as well as the amounts available are subject
to change from time to time and will be communicated
via the Divingniknaks website.
Unless otherwise specifically notified, NikPoints
can only be earned via the Divingniknaks web site,
and through following all and any instructions (for
example, email communications) regarding earning NikPoints.
A participant's failure to correctly follow any required
instructions or procedures may result in no NikPoints
being earned, for which the account holder will have
no recourse against R3 Midlands Ltd. or any participating
companies.
NikPoints earned are recorded against your account
information, however any NikPoints earned are never
available for redemption until payment has been received
in full from the participating company where those
NikPoints were earned to cover the cost allocation
of those NikPoints.
R3 Midlands Ltd. is not responsible for changes
to, or discontinuance of any NikPoints earning opportunity
through third party companies, nor are we responsible
for the inaccurate communication of NikPoints earned
through a participating site, by that participating
company.
You are responsible for assessing any tax implications
that may arise through collecting NikPoints, and for
the payment of any said taxes.
To redeem NikPoints against free rewards, discounts
and privileges, the account holder must have sufficient
NikPoints accrued and fully paid for by the relevant
participating companies. NikPoints that have been
allocated, but not yet paid for are never available
for redemption.
R3 Midlands Ltd. reserves the right to change the
range of products and services available for redemption
of NikPoints, as well as the number of NikPoints required
to make any such redemption from time to time and
will be communicated via the Divingniknaks website.
NikPoints are not redeemable for delivery charges.
Each individual joining NikPoints will register
under their username and password.
For authorisation and redemption purposes, you will
be required to identify yourself through your username
and password. For the avoidance of doubt, any individual
logging in with a correct username and password will
have full access to that account, and it is the sole
responsibility of the account holder to ensure that
this information is not made available to unauthorised
individuals.
NikPoints may not be transferred to other accounts
nor pooled together in any manner.
Unless specifically notified otherwise, all rewards
supplied in return for NikPoints are provided solely
by R3 Midlands Ltd.
NikPoints have no monetary value, and cannot be
used for any purpose other than redeeming designated
rewards. At no time will rewards be available to be
refunded for their cash value.
The sale or barter of NikPoints is strictly prohibited
by R3 Midlands Ltd.
By joining the NikPoints Rewards Programme you agree
to allow R3 Midlands Ltd, its partners and clients
to communicate with you via email with suitable offers,
which may contain opportunities to earn and redeem.
R3 Midlands Ltd will always use this communication
method responsibly. If you would prefer not to receive
such offers you can email NikPoints at: sales@divingniknaks.com
alternatively you are given the opportunity in every
email received to opt-out of receiving any further
communication.
In the event that a member expressly requests to
leave the NikPoints programme, no further communication
will be entered into between R3 Midlands Ltd. and
the individual. The individual will have 30 days to
redeem any NikPoints they may have collected subject
to the terms and conditions of the programme. After
this date, any unused NikPoints will be forfeited.
The NikPoints Rewards Programme is being offered
to individuals "as is" with no warranty to the maximum
extent as permitted by the law. R3 Midlands Ltd. disclaims
any representation and warranties, express or implied,
with respect to the programme, including, but not
limited to, implied warranties of merchantability
and fitness for any particular purpose.
R3 Midlands Ltd. does not make any warranty, guarantee,
or make any representations regarding the quality
of, or assurance of any advertisement or any merchandise,
products, or services offered or provided by third
party companies participating in the NikPoints Rewards
Programme.
You expressly agree that no NikPoints earned by
yourself are available for your redemption until payment
has been received in respect to these NikPoints, regardless
of whether they appear in your account information.
You will not hold R3 Midlands Ltd. responsible for
the non-collection of any monies due in relation to
your NikPoints, and the subsequent non-issuance or
removal of NikPoints from your account for this reason.
We may from time to time adjust your NikPoints account
upwards or downwards in respect to accounting errors,
non-payment from third parties, multiple accounts,
refunds issued, products returned or suspected fraud,
for which we have full authority.
R3 Midlands Ltd. reserves the right to terminate
the NikPoints Rewards Programme at any time. In the
event of this, you will have 30 days from the notice
date of programme termination to redeem any NikPoints
as per the above terms and conditions. Unless specified
otherwise, no additional NikPoints will be able to
be accrued during this Termination period.
R3 Midlands Ltd. will make every effort to communicate
to all members the termination period, however we
will not be held responsible for failing to notify
any individual regardless of the reason.
R3 Midlands Ltd. may modify this agreement from
time to time, with or without notice, and your continued
participation in the NikPoints Rewards Programme will
be deemed as your acceptance of the new terms and
conditions.
An individuals participation and acceptance into
the NikPoints Rewards Programme is subject to these
terms and conditions, and participation may be refused
at the sole discretion of R3 Midlands Ltd. without
recourse. Any fraud or abuse of the system will result
in the immediate termination of that account and total
forfeit of any NikPoints accrued.
All questions or dispute regarding the NikPoints
Rewards Programme, including without limitation, questions
regarding participation and eligibility must be submitted
in writing within 90 days of the query where applicable,
to R3 Midlands Ltd., Unit 10, Rovex Business Park,
Birmingham, B11 2AU. Any such dispute will be resolved
by R3 Midlands Ltd. at their sole discretion. All
interpretations of these terms and conditions shall
be at the sole discretion of R3 Midlands Ltd. In the
event of an error by R3 Midlands Ltd. your sole recourse
will be the crediting of any disputed NikPoints.
For the avoidance of doubt, these Terms and Conditions
shall be subject to the laws and jurisdiction of England.
If any provision of these Terms and Conditions is
found invalid or unenforceable, that provision shall
be enforced to the maximum extent possible, and the
other provisions contained herein will remain in full
force and effect. R3 Midlands Ltd’s failure
to insist upon or enforce strict performance of any
condition shall not be construed as a waiver of any
provision or right. Nothing in these Terms and Conditions
shall be construed as forming a partnership or joint
venture either with individuals enrolled in the NikPoints
Rewards Programme, or participation third party companies.
No third party company will have the right or ability
to create any obligation on R3 Midlands Ltd. behalf.
This agreement constitutes the entire agreement between
you and R3 Midlands Ltd in regards to the NikPoints
Rewards Programme.
Privacy Policy
R3 Midlands Ltd are committed to our customers privacy
and the following notes outline our information practices.
If you feel we are not abiding by our policy or if you
have any questions please contact sales@divingniknaks.com.
Personal Information
We collect basic personal information (Name, Address,
Region, email address etc.) from you as part of our
registration process to enable us set up your NikPoints
account.
We also collect information on your shopping &
online activities with our partners as part of allocating
NikPoints to your account.
From time to time we may also ask for additional
personal information as part of a promotion/competition.
Use of Information
By joining the NikPoints Programme you agree that
we can communicate with you with suitable offers from
Divingniknaks, its partners and clients, which may
contain opportunities to earn and redeem.
You may at any time remove yourself from the NikPoints
rewards programme in which case no additional communication
will be sent to that particular account and after
30 days any unredeemed NikPoints in that account will

Tracking
Cookie Tracking: We may store information about
you using cookies (files which are sent by us to your
computer or other access device), which we can access
when you visit our site in the future. We do this
to remember your login details and to award NikPoints
into your account. If you want to delete any cookies
that are already on your computer, please refer to
the instructions on your file management software,
which locates the file or directory that stores cookies.
Information on deleting or controlling cookies is
available at www.AboutCookies.org.
Please note that by deleting our cookies or disabling
future cookies you may not be able to access certain
areas of our site or receive points.
When you visit our site, we may also log your IP
address, a unique identifier for your computer or
other access device.
Website Security
All payments are process on a secure server, your
card details are never stored in any form by R3 Midlands
Ltd, unless you specifically request us to do so in
writing.
Passwords
Access to your account is password protected and
we never release details of this to third parties.
These details will only be released to the account
holder. If you have forgotten your password, please
visit the 'Forgotten log-in' section of the customer
login page to request your password and Username.
R3 Midlands Ltd. cannot be held responsible for
any activity in your account that has resulted from
a customer not keeping their account details secure.
General
We reserve the right to access and disclose individual
information to comply with applicable laws and lawful
government requests. We also reserve the rights to
disclose individually identifiable information to
third parties where a complaint arises concerning
your use of this web site, where that use does not
comply with our terms and conditions
Third Party Advertiser: We display advertising from
third parties on our site and we are not responsible
for the content or privacy polices of these sites
and third party advertisers, nor for the way in which
information about their users is treated.
